Article 1. SCOPE OF APPLICATION – GENERAL PROVISIONS

These general terms and conditions of sale (hereinafter “General Terms and Conditions”) apply to all sales made on the www.michel-ferrand.com website . They govern the contractual relationship between FERRAND DECORATION (hereinafter “MICHEL FERRAND”) and any Customer wishing to make an online purchase. MICHEL FERRAND is a brand owned by FERRAND DECORATION, a limited liability company with a share capital of 200,000 euros, registered with the LAVAL Trade and Companies Register under number 831 747 431, whose registered office is located at 3 route de sainte Suzanne 53270 Torcé viviers en Charnie – Telephone number: 02.43.90.45.76 – Intracommunity VAT number: FR46831747431.

Article 2. ENFORCEABILITY OF THE GENERAL TERMS AND CONDITIONS

The present General Terms and Conditions are accessible at all times on the site. By placing an order, the Customer unreservedly accepts these General Terms and Conditions. No order can be finalized without this acceptance. The Customer acknowledges that it is not necessary to sign these General Terms and Conditions for them to be applicable.

 

Article 3. ORDERS PLACED ON THE SITE

3.1 Placing an order
The customer places an order via the site and guarantees that all information provided is accurate. MICHEL FERRAND reserves the right to verify certain information before confirming the order. The information provided must be accurate. MICHEL FERRAND cannot be held responsible for any errors resulting in delays in delivery. 3.2 Terms of payment
Payment is required at the time of ordering. MICHEL FERRAND offers several secure payment methods, including the possibility of payment in installments under certain conditions. 3.3 Confirmation
Once the order has been validated, a confirmation e-mail is sent to the customer. 3.4 Estimated delivery date
The Customer will be informed of the delivery date when the order is placed. 3.5 Order cancellation
The Customer may cancel his order within 48 hours, provided that the goods have not yet been dispatched.

Article 4. PRICES AND PRODUCTS

4.1 Product information
Products are described as accurately as possible, but variations may occur. Photos are not contractual. 4.2 Prices
Prices include VAT and are quoted in euros. Delivery costs are invoiced in addition and are specified when the order is placed.

Article 5. DELIVERY

5.1 Before delivery
Before placing an order, the Customer must ensure that the products can be delivered without difficulty. This includes checking access (dimensions of doors, stairs, elevators, etc.) for the passage of furniture. 5.2 Delivery
Products are delivered to the address indicated at the time of order. The carrier will arrange a delivery date. In the event of absence or error in entering the address, additional charges may be invoiced for a new delivery. The customer undertakes to be present on the day of delivery to assist the delivery personnel. Any additional costs relating to the hire of elevators or delivery by cherry picker will be borne by the Customer and invoiced by the carrier in addition to the sale price and delivery charges mentioned on the Site. 5.3 Delivery times
Delivery times are set at 3 months. In the event of a delay, MICHEL FERRAND will inform the Customer as soon as possible if the initial deadline is increased. 5.4 Upon delivery
The Customer is required to check the condition of the products upon delivery. If no reservation is indicated on the delivery note, no recourse will be accepted and the delivery will be presumed to be compliant.

 

ARTICLE 6 – RIGHT OF WITHDRAWAL

In accordance with article L 221-18 of the French Consumer Code, the Customer has a right of withdrawal of 14 days from receipt of the product. This right allows the Customer to return the product for an exchange or refund.
Return shipping costs are at the Customer’s expense. However, this right of withdrawal does not apply to personalized or made-to-order products, in accordance with article L 221-28 of the French Consumer Code. In this case, no returns will be accepted. 6.1 Returns procedure
The Customer must notify MICHEL FERRAND’s Customer Service of his or her wish to withdraw by sending an email or letter to MICHEL FERRAND, together with proof of receipt of the product (such as a delivery note).
After receiving the request, MICHEL FERRAND will contact the Customer within 72 hours to inform him or her of the procedures for returning the product, which must be returned carefully packaged by MICHEL FERRAND and in perfect condition within the following 14 days.
Returns will only be accepted if the procedure is followed. In the event of a damaged product, MICHEL FERRAND reserves the right to refuse the return and/or to charge for repair. 6.2 Exchange or refund
The customer may choose between an exchange or a refund of the products. If an exchange is requested, the new items will be delivered within a standard period of 3 months. Refunds will be made within 14 days of receipt of the product by our teams, after verification of the condition of the returned products. Refunds will be made by the same method of payment used for the order, less any return postage.

ARTICLE 7 – WARRANTY

In any event, the Customer benefits from the legal warranty of conformity as well as the warranty against hidden defects in accordance with the legal provisions of articles L.217-1 to L.218-2 of the French Consumer Code and articles 1641 to 1649 of the French Civil Code. 7.1 Conformity defects
If a product is found to be non-conforming, the customer may request repair or replacement within 2 years of delivery. In the event of impossibility or excessive cost in relation to the value of the product, MICHEL FERRAND may opt for a resolution different from that initially requested by the customer. 7.2 Hidden defect
If a hidden defect is discovered within two years of delivery, the customer may request cancellation of the sale or a reduction in the price. 7.3 Warranty exclusions
Warranties do not cover :

  • Normal wear and tear.
  • Damage caused by poor maintenance (excessive light, incorrect cleaning products).
  • Accidents, impacts or incorrect use of products.

ARTICLE 8 – DISPUTES AND LIABILITY

The customer is responsible for the accuracy of the information provided at the time of ordering, in particular the delivery address. MICHEL FERRAND shall not be held liable for any errors resulting in incorrect or delayed delivery, or requiring specific means of access to the product’s place of installation.
MICHEL FERRAND shall not be held liable for any loss resulting from the impossibility of using the product due to unspecified characteristics.

ARTICLE 9 – MEDIATION

In accordance with article R 612-1 of the French Consumer Code, the customer may have recourse, free of charge, to a mediation service for any unsatisfied complaint after contacting customer service. This recourse is available via AME (Association de Médiation Européenne).

ARTICLE 10 – DATA PROTECTION ACT

MICHEL FERRAND undertakes to comply with current legislation on the protection of personal data (RGPD and Loi Informatique et Libertés). Customers have rights to their personal data (access, rectification, deletion, etc.) which they may exercise by contacting MICHEL FERRAND.

ARTICLE 11 – INTELLECTUAL PROPERTY

All site elements www.michel-ferrand.com are protected by copyright and remain the exclusive property of MICHEL FERRAND. Any reproduction, even partial, is strictly forbidden without prior authorization. Trademarks, logos, texts and images on the site are also protected by intellectual property law.

ARTICLE 12 – USE OF COOKIES

The site uses cookies to improve the user experience by remembering browsing preferences. Customers can disable cookies via their browser settings, although this may affect the use of the site.

ARTICLE 13 – SEVERABILITY OF CLAUSES

If any provision of these GTC is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. MICHEL FERRAND undertakes to replace any invalid provision with a valid provision having equivalent effect.

ARTICLE 14 – NON-WAIVER

The fact that MICHEL FERRAND does not assert a right or clause of these GTC at a given time does not constitute a waiver of that right or clause for the future.

ARTICLE 15 – LANGUAGE, APPLICABLE LAW AND JURISDICTION

These GTC are written in French and governed exclusively by French law. In the event of translation, the French text shall prevail. Any dispute will be submitted to the exclusive jurisdiction of the French courts, after an attempt at amicable resolution .
